Florida At Center Of Fight Over Anna Nicole Smith's Body

Broward County Medical Examiner Says He Needs Court Order

The fight over who gets Anna Nicole Smith's body may end up being battled out in Florida court.

Attorneys for her companion Howard K. Stern and her mother, Vergie Arthur, are preparing separate motions to submit to a local judge requesting that Smith's body be released to them for burial, Local 10 reported.

However, their requests may be trumped by the photographer who claims he fathered Smith's baby. A lawyer for Larry Birkhead said Tuesday she made two legal filings in Florida, where the model died last week.

Smith's body remains at the Broward County Medical Examiner's office under tight security.

On Tuesday, county coroner Dr. Joshua Perper said he took calls from attorneys representing both Stern and Arthur asking that the body be released for burial. Perper said no one will get the body unless he gets the OK from a judge.

"We need to hear -- to have a court order -- which will tell us to whom we shall release the body," said Perper.

Birkhead's lawyer filed a motion in Broward civil court to keep Smith's body where it is until Feb. 20, the date of the next hearing in his paternity lawsuit.

"We wanted to nail down the court's order, to domesticate the order in Florida," attorney Debra Opri told The Associated Press in a telephone call.

Most likely all of the parties involved will end up in court arguing over who will get the body of the former Playboy Playmate, Local 10 reported.
