Mother Resumes Testimony In Cuban Custody Case
Perez Continues Pattern Of Contradicting Self
POSTED: Tuesday, September 4, 2007
MIAMI -- The custody case of a 4-year old Cuban girl resumed Tuesday with her mother back on the stand as a reluctant witness, Local 10's Glenna Milberg reported.
Lawyers for the girl's father, Rafael Izquierdo, cross-examined Elena Perez on the details of her accusations that attorneys plotted to paint Izquierdo as a more involved and interested father than he might have been after Perez moved with the girl to the United States.
Izquierdo plans to raise his daughter in Cuba if he is granted custody.
Last week, Perez accused Izquierdo's attorney, Magda Montiel Davis, of stealing photos from an album, then pretending they were sent to Cuba to keep Izquierdo abreast of his daughter's development.
Under questioning Tuesday, Perez continued a pattern of contradicting herself. She told the court she had brought the album to Davis' home for dinner and left it there, but wasn't sure about the photos that were missing when she retrieved it.
Last week, a friend of Perez testified that Perez told her Davis stole the pictures when she wasn't looking.
The judge chastised the court-appointed translator several times for misquoting questions and answers in his translation.
"I need you to be perfect," said Judge Jeri Beth Cohen. "In this case, you can't afford not to be."
