MIAMI -- Police arrested a man accused of molesting a 10-year-old girl in the bathroom of a Homestead grocery store Sunday.

James Benard Bivens, 34, was arrested Sunday and charged with sexual battery on a minor, lewd and lascivious molestation on a minor, false imprisonment and simple battery.

According to an arrest report, Bivens sexually assaulted the girl as she was washing her hands in the women's restroom at a Winn-Dixie supermarket.

The report said Bivens grabbed her from behind against her will and took her into the last stall, where he sexually assaulted her. When the girl's mother entered the bathroom to check on her, the girl called out to her mother, who ran to the last stall and saw Bivens sitting on the toilet with her daughter's pants around her ankles.

Police said the mother notified a Winn-Dixie employee who tried to stop Bivens from getting away, but he punched the employee in the face. Employees called police and provided them with a description of the man, who was later identified as Bivens.
