Accused Killer Embraces Mom During Court Hearing

Accused killer Michael Hernandez shared an emotional moment in court with his mother on Monday during a hearing to discuss plans to move his trial to Orlando.

He was shackled but smiling. It was a rare look at the Michael Hernandez his parents know, the son they've seen for just moments at a time over four years. Their visits have always been private.

The moment came in court after a pretrial hearing as lawyers prepared to move the murder case from Miami to a courtroom at the Orange County Courthouse in Orlando.

The judge ordered the move to central Florida after days of trying to find jurors in South Florida who were unaffected by the massive media coverage of the brutal killing of Jaime Gough, the 14-year-old boy who Hernandez is accused of stabbing to death in 2004.

On Monday, the defense filed motions indicating they will argue Hernandez was insane at the time of Gough's killing.

"There's no rational understanding. The defendant didn't know the consequences of his act or know right from wrong," said one of Hernandez's attorneys.

Lawyers asked the judge when and how Hernandez will be moved from Miami to Orlando.

They also requested he be kept in solitary confinement, stating that Hernandez is "apprehensive about being shipped off to a strange place."

For months, Michael Hernandez sat expressionless in court.

During Monday's hearing he beamed when given the chance to be hugged and kissed by his mother in court.
