Attorney General Wants To Stop Vegas-Style Games At Seminole Casinos

Attorney General Bill McCollum wants a federal agency to step in and halt Las Vegas-style gambling at Seminole Indian casinos in Florida.

McCollum appealed to the National Indian Gaming Commission in a letter Friday.

In the letter, McCollum said, "The state of Florida is in the untenable position of having a tribal gaming operation, which everyone acknowledges is unauthorized, ongoing without the jurisdiction to stop the illegal activities. As the regulatory official holding the power to enforce this law, the chairman should take action immediately to see that the Tribe ceases its illegal activity until a valid compact can be consummated with the state of Florida."

Florida doesn't have jurisdiction to stop what McCollum called "illegal activities" on tribal property.

The tribe has continued offering banked card games and class III slot machines at its seven casinos, including the popular Seminole Hard Rock in Hollywood, even though the Florida Supreme Court has thrown out a compact permitting them.

Gov. Charlie Crist had entered into an agreement with the tribe in November 2007 to allow the games, and the tribe would give the state $100 million per year. The justices later ruled that Crist lacked authority to enter that agreement without legislative approval.

The Department of the Interior has no jurisdiction over the Seminole Tribe, and because its land is sovereign, neither does the state.

Experts said they do not think that the National Indian Gaming Commission will do anything in response to McCollum's letter, Local 10's Jeff Weinsier reported. If the commission does not do anything, the state of Florida can sue it. But sources said there is no federal, state or local agency that will head into the Hard Rock casino and shut down the games.
