Rooster Forced To Leave Beach Condo

Mr. Clucky Headed For Greener Pastures

Mr. Clucky, the rebel rooster that lives on South Beach, and his owner, Mark Buckley, are packing up their South Beach coop and heading to New Hampshire for life on a farm.

"We're looking forward to getting back on the road," Buckley told Local 10's Jonathan Vigliotti.

Buckley, Mr. Clucky and a few other feathered friends that call a condo on the 1600 block of Jefferson Avenue home, are trading in South Beach cocktails for a more modest lifestyle.

"I've got a 1966 Ford pickup. Mr. Clucky enjoys the ride. I've got a country home in New Hampshire," Buckley said.

Clucky's relocation is the latest in what has become a summer circus act. The production began in May when he was fined $50 for keeping Mr. Clucky as a pet. The city considers the rooster a farm animal, which is illegal to own on Miami Beach.

In July, Buckley argued in a courtroom that Mr. Clucky isn't used for food or profit -- one of the definitions of a farm animal -- but is instead a companion. But a hearing officer said Clucky had to go.

Leaving town won't be easy for the pair. Mr. Clucky has risen to celebrity status in South Florida ever since Buckley first found the injured bird in a bush and nursed it back to health.

"He's led parades, had vigils held in his honor," said a nostalgic Buckley as he looked through a collage of photos hanging on the wall of his apartment.

This won't be the first time Buckley and his bird have taken a road trip to New Hampshire. Buckley grew up in the state and still has family living there.

"Live free or die. That's the state's motto. That's what we're doing," he said.

Buckley said he's not sure how long he'll stay in New Hampshire. A lawyer representing him and Clucky said the bird will return to Miami Beach soon.

"We're going to appeal the court order. Clucky is nothing more that a good pet. That's it," said attorney Eric Marshall.

But the City of Miami Beach said the law is cut and dry. While officials are happy to see the bird move on, they said Mr. Clucky is always welcome back as a tourist.

"We're a very accepting crowd. Anyone can come and play with us," said Nannette Rodriguez who works for the city.

While Mark Buckley is taking time off from South Florida, he said this isn't the end of his friend.

"Mr. Clucky has family down here. He has a home here in Miami Beach. He's not just going," Buckley said.

Buckley said he plans on leaving next week and will keep his South Beach condo. Once the hearing officer writes the July order, Marshall said he will appeal.
