Man Beaten By Residents Was Unarmed
Family Questions If Homeowner Went Too Far

MIAMI -- The family of a man who went into a neighbor's yard and died after being beaten by the homeowner and his son is questioning whether the residents went too far.
Police said that on Thursday morning 23-year-old Cristobal Navarro jumped a neighbor's fence near Southwest 23rd Street and 31st Avenue. It is unclear why he was there, but police said he was not welcomed.
Navarro, who was unarmed, was confronted by the homeowner, Juan Kennedy Sr., and his son, Juan Kennedy Jr., who police said beat him with a golf club. Navarro died.
Juan Kennedy Sr. would not talk about what led up to Navarro's death, but he did tell Local 10's Jonathan Vigliotti about the aftermath.
"Death, no matter how you look at it, is a tragedy," he said. "It's a loss."
The Miami Police Department has not filed any charges against the Kennedys, although police stressed that the investigation is ongoing.
According to police, homeowners are legally allowed to protect their property. Navarro's family questions whether the Kennedys went too far.
"Deep inside, he was a good person," said Navarro's younger brother, Dennis. "It's amazing what people will do to protect their property. You don't do that. If someone's on your property unarmed, not doing anything, you're going to kill them?"
Cristobal Navarro's mother and brother said the Kennedys should have just called the police.
"My son was not armed. He didn't have any gun, nothing," said Lydia Navarro, Cristobal Navarro's mother.
Kennedy seemed to agree.
"I can't tell you what other people would do in a situation like that. I would probably handle it differently," he said.
