Teen Accused Of Trying To Kill Friend's Mother

MIAMI -- A 13-year-old boy accused of plotting to kill his friend's mother agreed to a plea deal with prosecutors in a Miami courtroom Friday morning.
The 13-year-old Miami Beach boy pleaded no contest to a lesser charge of aggravated battery, reduced from the initial charge of attempted murder. That means he will not have on his record that he agreed to help his 15-year-old friend kill his mother, Eliana Poveda.
Investigators said the plot was revenge on the older teen's mother for making him switch schools. The alleged plot was carried out one Friday evening in September, when, police said, the 13-year-old hid behind a gate while Poveda drove into the driveway, then stabbed her with a kitchen knife and ran scared when Poveda fought back.
The 13-year-old has been on house arrest in the custody of his parents for the last month and a half, allowed to leave jail largely on the testimony of the woman he was accused of stabbing.
Poveda told the court she was not afraid of her son or his friend.
According to his lawyer, four psychologists deemed the younger teen no danger, setting the stage for the plea deal.
"All parties realize that it is more appropriate for this 13-year-old boy to be looking at the four walls of his psychologist's office rather than the inside of a prison cell," said attorney Brian Bieber.
Under the terms of the plea deal, the 13-year-old will be on probation for six years, until he is 19 years old. He will have a curfew of 8 p.m. and must have no weapons or contact with his friend or Poveda. He also must undergo regular psychiatric treatment.
The 15-year-old boy remains in custody at a treatment center. His case has not yet been resolved and, because it is a juvenile case, the details are not public record.
