MIAMI -- A Miami city commissioner now faces felony charges and possible future suspension in connection to a scuffle with two police officers at Miami International Airport last month.
Johnny Winton, who police said was intoxicated, allegedly got into a fight with police in May after his flight was canceled.
Winton was charged Monday with two felony counts of battery on a police officer and disorderly intoxication, a misdemeanor.
According to police, American Airlines agents called for assistance after they claimed Winton became loud and abusive. The officers said when they told him to calm down, Winton identified himself as a commissioner and called them an obscenity.
Police said Winton then struck one officer with his elbow and kicked another before losing his balance and falling, hitting his head.
Under Florida law, the governor can remove government officials charged with felonies from office pending the outcome of the case. A spokeswoman for the governor said his office has not received Winton's charging documents and no decision has been made regarding suspension.
Prosecutors in Palm Beach County are assigned to the case. Miami State Attorney Katherine Fernandez Rundle took herself off the case to prevent any conflicts of interest.
Winton, a real estate investor, was first elected as District 2 commissioner in 1999.
Winton was unavailable for comment Monday. In a statement, his attorney said, "We're very disappointed that a decision has been made to initiate felonies. But we're hopeful it will be resolved fairly and as expeditiously as possible."
The day after his arrest, Winton apologized outside his Coconut Grove home, saying he could not undo that which occurred … but could only make "better choices in the future."
"Life is very interesting," Winton said. "You can work your entire life to build a good reputation and two choices that you make damage that reputation in the blink of an eye."
